READ THE APPEAL RESPONSE REPORT FROM THE DEPARTMENT OF ENVIRONMENTAL AFFAIRS AND THE RECORD OF THE FULL APPEAL

The Department of Environmental Affairs officials acknowledged receipt of the appeal presented by Cullinan and Associates, environmental lawyers acting for the EMS Foundation and the Climate Justice Charter Movement on Wednesday the 10th of May 2023.

Both appellants are registered Interested and Affected Parties and have previously submitted comments in respect of the Scoping Report and the Environmental and Social Impact Assessment.

We believe that the decisionmaker failed to give adequate consideration to the public comments submitted by the appellant and other I&AP’s during the Public Participation Process.

The decisionmakeer failed to consider relevant factors and / or considered irrelevant factors when taking its decision contrary to the provision of Section 6(2)(e)(iii) of PAJA.

The decision maker’s decision is neither reasonable nor rational.
